Kavitha (Government Advocate) ******** O R D E R The present writ petition is filed, assailing the action of the respondents, in not granting promotion to the petitioner. However, when the writ petition is taken up, the learned Government Advocate appearing on behalf of respondents submits that, while the petitioner has approached this Court, assailing the action of the respondents in not granting promotion, disciplinary proceedings were initiated against the petitioner and the petitioner was visited with an order of penalty of dismissal from service. 2. The learned Government Advocate further submits that the petitioner, assailing the order of dismissal from service had approached this Court, vide W.P.No.10053 of 2013, and this Court by an order dated 22.10.2019 had dismissed the said writ petition. 3. The learned Government Advocate further submits that the petitioner, aggrieved by the aforesaid order of dismissal of writ petition by the https://www.mhc.tn.gov.in/judis W.P. No.22177 of 2010 learned Single Judge, had filed a Writ Appeal before the Honourable Division Bench of this Court, vide W.A.No.1827 of 2021 and the same was dismissed on 30.01.2026. 4. On the basis of the above, the learned Government Advocate submits that, since the petitioner is no more in service, on account of dismissal from service, which order has attained finality before this Court, the cause in the present writ petition does not survive for consideration, as the same is only in relation to the promotion, which would arise if only the petitioner is in service. 5. In view of the above submissions, since, during the pendency of the present writ petition, the petitioner having faced with disciplinary proceedings, resulting in his dismissal from service, this Court is of the view that the cause in this writ petition does not survive for consideration and as such the writ petition has become infructuous. 6.
