Learned counsel submits that adverse remarks in the ACR of the petitioner for the period from 01.04.2008 to 23.12.2008 were made only on account of registration of an FIR bearing No.44 dated 17.10.2008 under the P.C. Act against him, wherein he has been acquitted vide judgment dated 17.04.2009 and even in the departmental inquiry initiated on the same set of allegations, he stands exonerated, thus, he prays that the matter be reconsidered in view of Rule 16.3 of Punjab Police Rules as also the judgment of this Court in Baldev Singh and Another vs. State of Haryana and Others, CWP-1258-2020, decided on 26.08.2025 in a time bound manner. The aforesaid facts having been brought out, during the course of hearing, learned State counsel, on instructions, states that the respondents would not be averse to have a relook at the matter and decided afresh, expeditiously, in accordance with law, taking note of the aforesaid rule and judgment, uninfluenced by the orders impugned herein which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. 3. The matter stands disposed of accordingly and if the petitioner is found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same may be passed after granting opportunity of hearing to him and shall contain reasons, whereupon he shall be free to seek legal redress thereupon.
