Learned State counsel refers to preliminary submissions of the written statement of respondent Nos.1 to 4 wherein it has been stated that petitioner joined service as Clerk on 07.08.2006 and had made no representation with regard to his claim w.e.f 1999. Moreover, in the said year, there were 5 sanctioned posts of Clerk available in the office of answering respondent, out of which, 3 had already been filled up and 2 other employees working as Instructor, were adjusted against these posts, thus, there is no post available for him to be promoted upon, which has not been rebutted by filing any replication. 3. Disposed of, reserving the petitioner with a liberty to get it revived by demonstrating that cause still subsists.
