By all the present applications, the applicants are seeking condonation of delay, in filing the applications for setting aside of the abetment, and permission to bring the legal heirs of respondent No.1D on record. 2. Needless to state that, the legal heirs of respondent No.1-A, 2-A and 4-A are already on record. The respondent No.1-D Anil Prabhakar Marliwar, died on 04/05/2021 during pendency of the present appeal and there is delay for bringing his legal heirs on record. 3. Considering the facts and circumstances of the case, it is necessary to permit the appellant to bring the legal heirs of deceased respondent No.1-D on record. Accordingly, the delay, if any, caused in filing the application for bringing the legal heirs of respondent No.1-D on record is hereby condoned. The abetment is quashed and set aside, and the 2 912fa147.2010.odt appellant is permitted to bring legal heirs of deceased respondent No.1-D on record. 4.
