Learned counsel for the respondent also endorsed the same. Having considered the facts and circumstances of the case and on perusal of the order dated 20.08.2010 in C.E.A. No.95 of 2010 and batch, this Court satisfied that the present appeal is erroneously disposed of along with the said batch of cases and accordingly, the order dated 20.08.2010 in C.E.A. No.95 of 2010 passed by the Coordinate Bench of this Court is hereby set aside and restore this appeal to its file for fresh hearing.
