Ramesh) 1. Being aggrieved by the Common Order dated 25.02.2010 passed in M.C.No.261 of 2005 by the learned Judge, Additional Family Court, Visakhapatnam, whereby maintenance at the rate of Rs.3,000/- per month was awarded in favour of the respondent, the appellant has preferred the present appeal. 2. When the matter is taken up for hearing, there is no representation on behalf of the appellant. It is further noted that the present appeal pertains to the grant of maintenance. 3. In view of the absence of representation on behalf of the appellant and the nature of the appeal, this Court is of the considered view that no useful purpose would be served in adjourning the matter any further. Accordingly, the present Family Court Appeal is dismissed for non-prosecution. 4. However, it is made clear that if the appellant has any grievance or instructions at a later stage, he shall be at liberty to file an appropriate application seeking restoration of the appeal, and if such application is filed, the same shall be considered and decided in accordance with law on its own merits. There shall be no order as to costs. 4 Interim orders, if any, granted earlier shall stand vacated, and all pending miscellaneous petitions, if any, shall stand closed. __________________ JUSTICE D.
