1. Prayer in this appeal is for setting aside decision dated 06.07.2010 in W.P.No. 25130 of 2009 passed by learned Single Bench, whereby writ petition filed by the respondent–writ petitioner was disposed of by setting aside order dated 17.03.2009 and directing reinstatement of writ petitioner in service forthwith and to be continued till a final decision is taken by University regarding age of retirement of cadre of petitioner. 2. It is brought to our notice that respondent-writ petitioner was served with proceedings in Roc. No. C1/50/SVIMS/1992, dated 17.03.2009, which is prior to passing of impugned order dated 06.07.2010, and had accepted that he would be relieved upon attaining the age of superannuation of 60 years on

30.11.2009. Accordingly, writ petitioner was relieved from service of SVIMS on the afternoon of 30.11.2009 upon attaining the age of 60 years. Thereafter, all his pensionary benefits were released and he is being paid pension regularly. Subsequently also all Faculty Doctors were retired from service upon attaining age of 60 years till 01.06.2014. Age of superannuation of Faculty (Medical) Doctors working in institute was enhanced from 60 to 62 years with effect from
02.06.2014. 3. It is submitted that writ petitioner, till date of his retirement and even after passing of impugned order dated 06.07.2010, till stay of its operation on 26.07.2010, had never raised any objection or claim. 4. Perusal of record reveals that, on the last occasion, none had appeared on behalf of respondent-writ petitioner. Today, again, there is no representation on behalf of respondent–writ petitioner. It is brought to our notice at this stage that writ petitioner has since passed away. 5. In view of facts and circumstances stated above, we close the proceedings at this stage, with liberty to appellant to file an appropriate application in the event of any claim being raised by legal heirs of respondent– writ petitioner. 6. Writ Appeal is closed, accordingly. 7. Pending miscellaneous application(s) are disposed of, accordingly.
