2. The present appeal under Section 96 of the CPC seeks the following prayers:- (i) To allow this appeal and set aside the Order dated 03-10- 2009 passed by the learned ADJ, Delhi.
(ii) To grant any other and further relief which may be deemed fit and proper in the interest of justice;
(iii) To award costs in favour of the appellant”
