Present appeal has been filed for setting aside order dated 19.03.2009 passed by learned Single Bench, whereby writ petition filed by respondent/writ petitioner was allowed and steps were directed to be taken to alienate land in question in his favour and permit him to till the land. Learned counsel for appellant submits that whereabouts of respondent/writ petitioner are not known; Possession of property in question was with appellant and has been given on lease to respondent No.3 in writ appeal and that no claim has been set forth by respondent/writ petitioner for 2 HCJ & NJS, J W.A. No:679 of 2009 transfer of land in question since long years. Therefore, proceedings in present writ appeal may be closed with liberty to appellant to file appropriate application in case any such claim is now raised.
