The suit has been filed against the respondent/defendant for partition. As seen from the proceedings of the Sub Court, Bhavani, the suit has been returned raising queries on the petitioner on several occasions. The petitioner has categorically claimed before this Court that the suit is maintainable and the suit ought to have been numbered by the Sub Court, Bhavani. However, as seen from the docket orders placed on record before this Court, the contentions of the petitioner as raised in this revision with regard to the maintainability of the suit have not been considered by the Sub Court, Bhavani. 4. Therefore, in the interest of justice, this Court, directs the Sub Court, Bhavani to list the suit in OS (Filing) No.505 of 2024, dated 27.10.2025 filed by the petitioner under the caption ‘for maintainability’ on 17.07.2026. On that date, the petitioner’s counsel shall try to convince the Sub Court, Bhavani that the said suit is maintainable. If the trial court finds the said suit is maintainable, the trial court shall number the said suit, if it is otherwise in order and if the trial court finds that the suit is not maintainable, the trial court shall pass a speaking order with regard to the contentions of the petitioner for not entertaining the said suit. https://www.mhc.tn.gov.in/judis CRP No. 2009 of 2026 ____________ Page No.3 of 4 5. Registry is directed to return the original plaint filed before this Court to enable the petitioner to re-present the same before the Sub Court, Bhavani for the purpose of arguing the suit with regard to its maintainability aspect. 6.
