This appeal was listed on 15.04.2026 for final hearing. On verification of records, and the endorsement made, we found that the case was dismissed as https://www.mhc.tn.gov.in/judis TCA No. 1351 of 2009 __________ Page2 of 3 withdrawn, pursuant to the endorsement made by the learned counsel on record for the appellant as early as on 25.06.2019. However, the status maintained by the Data Bank of this Court indicated that on 13.08.2019, the earlier order was revoked and the appeal has been listed again for hearing. To verify the records, the matter is adjourned. Today, on perusing the records, we find that there is an endorsement by the learned counsel on record on 25.06.2019 itself seeking permission to withdraw this appeal. Accordingly, the matter has been dismissed on 25.06.2019 itself and the order has also been passed on that date. By inadvertence, there is some entry in the Data Bank that the order has been revoked. Hence, it has again been listed today for consideration. We are of the view that since the appellant has already made an endorsement through his counsel to withdraw the appeal, the appeal stands disposed of, and the matter need not again be re-heard. Registry is directed to delete the entry if any made on 13.08.2019 revoking the earlier order dated 25.06.2019. (G.J.,J.)
