JUSTICE RAJIV ROY ORAL ORDER 5 13-08-2026 Heard the parties. 2. The present petition has been preferred for the following relief(s): “for the transfer of Misc. Case No. 04 of 2021 pending in the Court of learned Principal Judge, Family Court, Patna, to the Court of learned Principal Judge, Family Court,Madhepura or recall Execution Case no. 108 of 2023 from Hon’ble Court of District Judge, Madhepura to Hon’ble Court of District Judge Patna and the petitioner Patna High Court MJC No. 2009 of 2025(5) dt.13-08-2026 2/3 humble pray before his Hon’ble Court to stay the execution proeceeding in Execution Case No. 108 of 2023. And for issuance of an order or direction which your Lordships may deem fit and proper in the facts and circumstances of the case. 3. Mr. Shashi Bhusan Kumar representing the opposite party submits that if the case is allowed, he has no objection. However, he be allowed to appear through the video conferencing. Learned counsel for the petitioner has no objection. 4. With the consent of both parties, Misc. Case No. 04 of 2021is hereby transferred from the Court of the learned Principal Judge, Family Court, Patna, to the Court of the learned Principal Judge, Family Court, Madhepura, with liberty to both parties to appear either physically or virtually through video conferencing. 5. In the event that the learned Principal Judge, Family Court,Madhepura, considers the physical presence of the parties necessary for the purpose of mediation, an appropriate order may be passed directing the parties to remain physically present on the particular date fixed for such mediation.
