CMP No. 1478 of 2014 in RSA No. 250 of 2009 and CMP No. 797 of 2025 in RSA No. 254 of 2009 The presnt applications were filed on 18.08.20212 under Order 39 Rule 2A CPC for taking action against the non- applicant for violation of the order of the Court. The record shows that the Court had only stayed the operation/execution of the judgment and decree on 04.06.2009. Subsequently, an application under Order 39 Rules 1 and 2 CPC was filed and an order of interim injunction was passed on 06.01.2022. There was no order in existence on the date of filing of the application. An application under Order 39 Rule 2 A CPC only lies for violation of the order. Since, there is no order, therefore, these applications are dismissd as having become infructous. Applications stand disposed of RSA No. 250 & 254 of 2009 Arguments heard. Judgment reserved.
