On 04.07.2023, none appeared for the appellants and in the interest of justice, the case was adjourned to 17.07.2023. On 17.07.2023, this Court dismissed the appeal in default on account of non-appearance on behalf of the appellants. Thereafter, CMP No.3762 of 2024 was filed for the restoration of appeal. This Court on 27.03.2024, issued notice on the said application to the non-applicant/respondent. Subsequently, this Court, vide its order dated 29.04.2024, allowed the said application and the appeal was restored to its original number. On 29.11.2024, the matter was listed before Additional Registrar (Judicial), where it was ordered that appropriate steps for bringing on record the legal heirs of the deceased appellant No.2 were not taken, in pursuance of the order which was passed by this Court on 22.08.2024. Before the Additional Registrar (Judicial), none appeared on behalf of the appellants. When the case was listed on 03.03.2025 before the Court, none appeared for the appellants, and it was ordered that needful for bringing on record the legal heirs of deceased appellant No.2 be done on before the next date of hearing, failing which the consequences on account of non-prosecution shall ensue. Thereafter, again on 09.04.2025, when the matter was listed before the Court, no one appeared on behalf of the appellants. Consequently, the matter was ordered to be listed for hearing in due course. Today, when the matter was called for hearing, there was no appearance on behalf of the appellants, nor consequential steps for bringing on record the legal heirs of deceased appellant No.2 have been taken till date. It seems that the appellants are not interested in pursuing the appeal as no one has appeared before this Court on their behalf. Consequently, the appeal is dismissed in default.
