The applicants have filed these applications for condonation of delay of 1771 days in setting aside abatement and bringing the legal heirs of deceased respondent on record. The appellants have stated that the respondent died in the year 2018 and the learned Counsel for the respondent died in the year 2022, therefore, there is a delay. 2. Considering the reason given in the application, delay is condoned subject to costs of Rs.5,000/- to be paid in the Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur, bearing Account No.129712010001014 and IFSC Code UBIN0812978. The abatement is set aside and the appellants are permitted to bring on record the legal heirs of respondent within a period of two weeks. It is informed by the learned Counsel for the appellants that the legal heirs of 2026:BHC-NAG:11467 2 sa84.2008 respondent are served through public notice.
