1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). Misc. Case No.645 of 2007
2. This is an application filed at the instance of the Appellant- Insurance Company for condonation of delay of 245 days in the presentation of the appeal at the instance of the Appellant- Insurance Company.
3. Heard Mr. G.P. Dutta, learned counsel for the Appellant- Insurance Company as well as learned counsel appearing for the Respondent-Claimant. Perused the grounds taken in the misc. case for condonation of delay.

4. On perusal of such ground, this Court found that the grounds taken therein are not sufficient to condone the delay. Considering the fact that there is a delay of 245 days and that the award is of the year 2007. In the meantime, almost two decades have elapsed.
5. Taking into consideration the aforesaid fact, this Court is not inclined to condone the delay, accordingly the Misc. Case stands dismissed.

6. Since this Court was not inclined to condone the delay, the appeal also stands dismissed confirming the judgment passed by the 2nd MACT, Sambalpur in Misc. Case No.15 of 2005 which arises out of Misc. Case No.278 of 1998 dated 28.02.2006, the right to recovery granted by the learned Tribunal is hereby confirmed.
7. Accordingly, the appeal stands disposed of.
8. Mr. Mihirkanta Rath and B.K. Nayak, learned counsels appearing for the Claimant-Opposite Party No.1 be reflected in the cause list as well as in the brief henceforth.
