The petitioner being the accused was facing trial for the alleged commission of offence under Section 138 of the NI Act in ICC Case No. 4985 of 2004, whereby the learned SDJM, Bhubaneswar convicted the petitioner for the charged offence sentencing him to undergo S.I. for six months and to pay a compensation of Rs.74,500/- vide judgment dated 27.01.2006, which has been affirmed by learned Adhoc Addl. Sessions Judge, FTC-II, Bhubaneswar in Crl. Appeal No.3/10 of 2006. Being aggrieved by the aforesaid orders, the petitioner has filed the present revision. 2. None appears for the petitioner at the time of call. 3. This revision petition is pending since 2007. Perusal of the proceeding of this Court dated 13.05.2017 reveals that the counsel for the petitioner made a statement before this Court that the matter has already been settled and the payment has already been made by the petitioner to the opposite party. 4. Mr. Nayak, learned counsel for the opposite party submits that statement has falsely been made before the Lok Adalat on 13.05.2017 that the matter has been settled. Therefore, the matter has been listed before this Court. 5. The matter is prolonging since 2007 and the petitioner has unrepresented. 6.
