01. By this petition, the petitioner is seeking a direction upon the respondents to release the admitted liability arising out of the execution of the work relating to replacement of outlived old power cables with new cables of the existing critically overloaded 13/11 KV substations (RM Works) under PMDP-R (Additional) in District Baramulla as well as District Kupwara, along with interest @ 12% per annum from the date of completion of the work till realization of the amount in favour of the petitioner. The petitioner has prayed for a direction to the respondents to release the due payment of Rs. 43,40,833/- in his favour.
02. It is stated that the respondents issued an allotment for execution of the aforesaid work and allotted the contract to the petitioner. It is Mohammad Yaseen Dar I attest to the accuracy and authenticity of this document
further stated that the petitioner completed the work within the stipulated period and in accordance with the directions of the respondents and the terms and conditions of the work order.
03. It is further stated that the petitioner had borrowed money from his creditors and has been paying substantial interest thereon. The petitioner was, therefore, expecting that the payment due to him for the completed work would be released within the stipulated time. However, the respondents have, allegedly, withheld the said payment till date.

Learned counsel for the petitioner submits that he would be satisfied if the respondents are directed to consider and release the admitted liability due to the petitioner.

Having regard to the prayer made by learned counsel for the petitioner, the instant writ petition is disposed of with a direction to the respondents to consider the claim of the petitioner, as projected in the writ petition, and take a decision thereon within a period of two months from the date a certified copy of this order is furnished by the petitioner to the respondents, subject to verification of the requisite bills and other relevant records. The decision so taken shall be conveyed to the petitioner.
