Record reveals that learned arguing counsel did not appear for four consecutive dates of hearing and have entered appearance through proxy counsel and when the matter was listed on 11.12.2025, same was the position and in the aforesaid backdrop, the Court was constrained to impose cost upon the petitioner to the tune of Rs. 1000/- while adjourning the matter. Thereafter, the matter was listed on 12.02.2026 when the Court has noted that cost in terms of the last order has not been deposited. 2. Today also, when the matter was taken up, neither the cost has been deposited nor there is any representation on behalf of the petitioner, therefore, inference can be drawn that the petitioner has lost interest in prosecuting the instant petition. 3. Accordingly, the instant petition is dismissed for non- prosecution. 4. Interim directions, if any, shall stand vacated.
