( Oral ) The petitioners through instant petition under Articles 226/227 of Constitution of India are seeking direction to respondents to release the compensation in respect of their acquired land in terms of the award dated 25.06.2007 (Annexure P-7). On 11.12.2025,the following order was “Learned State Counsel submits that the amount of compensation in terms of original award dated 25.06.2004 passed by the Land Acquisition Collector stands released in favour of th month of November, 2025. However, she prays for time to have instructions about the payment against the enhancements awarded by the learned Reference Court as well as this Court vide its decision No.1626 of 2011 filed at the instance AJAY PRASHER 2026.07.21 17:31 I attest to the accuracy and integrity of this document CWP-26817-2023 (O&M) -2- In the given facts, wherein the respondents have delayed the disbursal of the original amount of compensation for a period of 21 years after passing of the award in the year 2004, it would be more appropriate in case the petitioners are released the enhanced amount of compensation as granted in favour of the other similarly placed landowners rather than relegating the petitioners to the remedy of reference petition or filing of RFA etc., once the determination of the market value pertaining to the same acquisition proceedings already stands finalized. List on 18.12.2025 for further consideration. Henceforth, the case be shown in Urgent List.” 3. Learned counsel for the petitioners submits that respondents, during the pendency of this petition, have released compensation determined vide award dated 25.06.2004. They may be granted liberty to avail remedies as permissible by law with respect to their other claims. 4. Dismissed as withdrawn with aforesaid liberty. 5.
