Reference in the index was made to CWP-14056-2006 titled as Manoj Kumar vs. State of Haryana, involving the similar question of law, which was disposed of by upholding the order passed by police authorities with a modification that petitioner shall be deemed to have been removed from service.

Learned counsel for the petitioner relies on judgments Dhan Singh vs. State of Haryana and others, CWP-1309-2008, decided on 26.05.2008 and Rajinder Kumar vs. State of Haryana etc., CWP-19992-2009, decided on 01.04.2010, Annexures P7 and P8, respectively, also on the issue as involved in the present case and states that petitioner had rendered 18 years of service, thus, prays that his case be re-considered in light thereof.

Learned State counsel has no objection to the limited prayer made.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to re- consider the claim of the petitioner, expeditiously, in accordance with law, taking note of the aforesaid judgments, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to the interest of the petitioner, the same shall contain reasons and he shall be free to seek legal redress thereupon.
