( 1 ) THIS petition under Article 226 of the Constitution of India has been made on behalf of the petitioner who is undergoing sentence under Sections 21/29 of NDPS Act for parole. He has sought parole for a period of three months on the ground that his family has got disintegrated and he wants to reconstitute his family. ( 2 ) THE appellant has been sentenced to 14 years of Rigorous imprisonment and is in jail for 7 years and 7 months and his remaining sentence is 5 years and 5 months. ( 3 ) A perusal of the record shows that the appellant had been sentenced in another case being Sessions Case No. 35 of 2000 under Section 21/29 of NDPS Act. However, looking into the fact that he all along remained in jail for 7 years and 7 months, the appellant is granted parole for a period of 30 days, from the date of his release from jail, on his furnishing personal bond in the sum of rs. 50,000/- with one surety in the like amount to the satisfaction of Jail superintendent. ( 4 ) THE petition stands disposed of in above terms.
