JUSTICE VIKAS MAHAJAN O R D E R % 23.03.2026 I.A. 7620/2026 (under Order XXIII Rule 3 read with Section 151 CPC) 1. The present application has been filed jointly by the parties praying for disposing of the suit in terms of Memorandum of Understanding (hereinafter ‘MoU’) dated 18.03.2026. 2. The present suit for specific performance and permanent injunction of agreement dated 10.10.2006 was filed by plaintiff against Smt. Krishna Bhat. 3. In the written statement, Smt. Krishna Bhat claimed that she has executed a registered gift deed in favour of the defendant Nos. (ii) to (vii). Defendant no.(v) was the husband of late Smt. Krishna Bhat, who also passed away during the pendency of suit. 4. The settlement has been arrived at between the remaining parties i.e. This is a digitally signed order. (vi), (vii), as well as, by the defendant no.(ii) on her own behalf, as well as, on behalf of her sister namely, Mrs. Mona Bhat [defendant no.(iii)] and another sister namely, Smt. Shivani Chadha [defendant no.(iv)]. The Court has perused the memorandum of understanding and find the same to be lawful. 6. The plaintiff has joined the proceedings through VC and he affirms the factum of settlement. 7. Likewise, defendant nos.(ii), (vi) and (vii) are present in Court and they also affirm the factum of settlement. 8. In view of the above, this Court does not find any impediment in decreeing the suit in terms of the above settlement. 9. Accordingly, the suit is decreed in terms of the MoU, which shall form part of the decree. The party shall remain bound by the terms of the MoU. 10. The application stands disposed of. CS(OS) 1642/2007 11. Let decree sheet be drawn. 12. In view of the order passed above, the suit stands disposed of. 13.
