This is a writ petition filed under Articles 226 and 227 of the Constitution of India seeking the following prayers:- “(i) grant of writ of Mandamus or any other writ in the nature of mandamus directing the Respondents not to charge interest in respect of the said excess land next to plot No. 32 admeasuring 119.36 Sq. meters. (ii) Grant of writ of mandamus or any other writ in the nature of mandamus directing the Respondents to transfer the said excess land next to plot No. 32 admeasuring 119.36 Sq. meters at the price and payment of Rs. 22,43,609.92 to the Petitioner.” 2. The facts are that initially an Industrial Plot 32, Block-II, Kirti Nagar, WHS, New Delhi was allotted to Shri Jindu Ram. The said plot No. 32 was then mutated in the petitioner’s name on or around 21.05.1996. This is a digitally signed order. There was some vacant land adjacent to the plot No. 32 and vide demand letter dated 31.10.2001, the said vacant land adjacent to plot No. 32 admeasuring 119.36 sq. meter (approx.) was allotted to the petitioner at Rs. 32,30,836/-. 4. The petitioner vide letters dated 26.11.2001 and 29.11.2001 sought reduction in the said amount as in another instances such vacant lands was allotted by the respondents for lesser price. 5. The representation of the petitioner is of the year 2001 and the respondents responded after 6 years vide letter dated 18.01.2007 reduced the price from Rs. 32,30,836/- to Rs. 22,43,609.92/- and charged Rs. 24,23,099/- as interest along with other extra charges. 6. Hence, the present petition. 7. Mr. Sood, learned counsel for the petitioner, states that even though the amount charged as interest is not fair, in order to put a quietus to the entire controversy he is ready to pay the amount calculated by the respondents. 8. Ms. Farah, learned counsel for the respondents, on instructions has handed over a “Calculation sheet of additional plot adjoining to plot no. 32, Block-II, Kirti Nagar, WHS” showing total dues payable by the petitioner as Rs. 87,02,963.00/-. 9. However, the table under heading “Detail of payment against above demand” shows that the petitioner deposited a sum of Rs. 24,23,099/- on 18.05.2007 and another sum of Rs. 2,69,233/- on 29.04.2011. 10. It is therefore directed that the amount paid by the petitioner on 18.05.2007 and 29.04.2011 will charge the same interest @ 15% per annum (which is being charged by the respondent from 29.04.2011 to 31.05.2018). After reducing the said amount from Rs. 87,02,963.00/-, the petitioner shall pay the balance amount within 4 weeks from today. 12. On making the payment, the lease for the property in question shall be executed in favour of the petitioner. 13. The petitioner shall also pay interest for 4 weeks at the rate of 10% per annum. 14. Ms. Farah, learned counsel for respondents, assures that calculations up to 10.03.2026 will be provided within 2 days from today after adjusting the interest due and payable to the petitioner. 15. The present petition is disposed of in aforesaid terms, along with pending applications, if any. 16. The Calculation sheet handed over in the Court today is taken on record.
