This Appeal is filed challenging the order and decree dated 28.06.2006 passed in H.M.O.P. No.51 of 2002 on the file of the learned Judge, Family Court-cum-V Additional District Judge, Tirupati. 2. When the matter is taken up for hearing, the learned counsel for the appellant submits that, despite his efforts, he could not secure any instructions from the appellant in this appeal of the year 2007 and is therefore unable to prosecute the matter. 3. In view of the submission made by the learned counsel for the appellant and as no instructions have been received from the appellant for a long time, this Court is satisfied that the appellant is not inclined to pursue the matter further. 4. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. However, liberty is granted to the appellant to file an appropriate application seeking revival/restoration of the 4 appeal, if any instructions are received subsequently. There shall be no order as to costs.
