THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE SUBHENDU SAMANTA WRIT PETITION NO: 25421/2007 ORDER: (per Ravi Nath Tilhari, J)
The respondents herein filed OA.No.4418 of 2002 for direction to the respondents therein to allow the minimum scale of pay attached to the applicants of OA from the date completion of five years of service as NMRs workers with all consequential benefits along with arrears. 2. The Tribunal allowed the OA by judgment dated 11.09.2006 and directing the respondents to continue to pay the minimum scale of pay attached to the posts to which the applicants belong from the date of completion of five years of service. Challenging the same, the respondent in OA has filed the present Writ Petition. 3. On 04.12.2007, the interim order was granted providing that the petitioner – Municipality shall continue the payment of minimum time scale to the respondents. However, the payment of arrears was stayed until further orders. 4. None appears for the petitioner. 5. The matter pertains to the year 2007 and is listed under the caption „old matters‟. 6. In view of the above, the Writ Petition is dismissed for “want of prosecution”. No order as to costs.
