JUSTICE R.K. PATTANAIK Order No. ORDER 15.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with NTPC P.S. Case No. 178 of 2026 corresponding to G.R. Case No. 1761 of 2026 pending in the court of learned SDJM, Talcher on the grounds stated. 3. Perused the FIR as at Annexure-1. The petitioner had earlier approached this Court in ABLAPL No. 11318 of 2025 disposed of on 2nd December, 2025 and was denied bail unlike two others. A copy of the said order is produced at the time of hearing. The order in ABLAPL is also at flag-A in the Court’s record. While disposing of the ABLAPL, this Court allowed two other accused persons to surrender for being released on bail with conditions, whereas, it was denied for the petitioner. Recording the submissions of learned counsel for the respective parties, the Court is not inclined to reconsider any such plea in view of the order in ABLAPL but allows the liberty for the petitioner to surrender before the learned court below seeking regular bail and in case of rejection to approach the Sessions Court during the second hour for orders. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders within a fortnight from today and moves an application for regular bail, it is directed that the same shall be considered by learned SDJM, Talcher in connection with NTPC P.S. Case No. 178 of 2026 corresponding to G.R. Case No. 1761 of 2026 during the first hour and in the event of rejection, he shall approach the learned Sessions Court during the second hour for orders on the same day with a decision on merit pleading parity for the release of the co-accused persons and for the said purpose, the case record shall be made available. 6.
