3. However, learned Government Pleader for Higher Education appearing for respondents has assisted this Court by making following
submissions:
(i) Initially, letter, dated 26.05.2005, came to be addressed to this Court in relation to publishing of names and photos of rank holders while advertising results of EAMCET with various newspapers, in a way causing frustration among students and instigating the parents to pressurize their children for achieving the targeted results. Thus, the same was taken up by way of Public Interest Litigation as W.P.No.12535 of 2005. (ii) Similarly few other writ petitions also came to be filed before this Court against specific colleges, and sought for appropriate action under the provisions of the Andhra Pradesh Public Examinations (Prevention of Malpractices and Unfair Means) Act, 1997, for issuing false, fake and mischievous advertisements regarding ranking and selection of students to various professional courses. (iii) All these cases came to be disposed of by a common order, dated 03.04.2006, inter alia, directing official respondents or public spirited persons, who are interested in stopping the menace of misleading and false advertisements being issued by educational institutions and training institutes, to bring to the notice of this Court any misleading publication, which may be issued in future by any
3 HCJ & CGR, J. I.A. No.2 of 2006 in WP No.12535 of 2005 educational institution, so as to enable this Court to pass further appropriate orders. 4. That being so, present I.A. has been filed seeking the relief as mentioned supra. 5. Factually speaking, the issues highlighted in I.A., i.e. conducting of talent test by private educational institutions, besides the respondent managements contemplating to acquire the locally recognized schools in each town circumventing the directions of this Court in W.P.No.12535 of 2005, under common order, dated 03.04.2006, in a way do not directly touch upon the issues those that were highlighted in the main writ petitions. 6. Be that as it may, learned Government Pleader for Higher Education appearing for respondents, on instructions, would state that the Government had already taken appropriate steps by issuing various instructions and as well as Government Orders prohibiting the conduct of talent tests by private educational institutions and also prohibiting declaration and advertising of names in the Intermediate Public Examinations in any form at private college levels. The following G.Os. and circulars are sought to be relied on for the aforesaid purpose.
(1) G.O.Ms.No.42, School Education (PE.PROG.I) Department, dated 30.07.2010;
4 HCJ & CGR, J. I.A. No.2 of 2006 in WP No.12535 of 2005 (2) Proceedings of Commissioner of School Education, A.P., in Rc.No.163/PS-1/2015, dated 23.04.2016; (3) Proceedings of Commissioner of School Education, A.P., in Rc.No.118/PS-1/2014-2, dated 07.06.2018; and (4) G.O.Rt.No.119, School Education (IE-A1) Department, dated
20.07.2022. 7. We have gone through the aforesaid G.Os. and circulars and are satisfied that the respondent-State has already taken sufficient measures to deal with the menace of conducting of talent test by private educational institutions and also providing for consequences in case one indulges in such activities. 8. We, therefore, are of the view that no further directions are required to be issued in this regard. 9. Accordingly, the Interlocutory Application is closed. No order as to costs. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. LISA GILL, CJ CHALLA GUNARANJAN, J. cs
