Learned vice counsel for the appellant, under instructions received from the original counsel Mr.Dushyant Dadwal, Advocate, submits that the appellant-company has already been amalgamated with M/s Sturdy Industries Limited and Mr. Anurag Goel, has been appointed as the Interim Resolution Professional of M/s Sturdy Industries Limited, who has taken over the charge of the Company. He further submits that despite various communications, the appellant is not responding and,therefore, this Court may pass appropriate order in this respect. I have heard learned counsel for the parties and also gone through the record of the case. The present appeal has been filed by M/s Swati Storewel Pvt. Ltd. under Section 96 read with Order 21 Rule 103 of CPC against the judgment and order passed by the Additional District Judge (Presiding Officer, Fast Track Court), Solan, District Solan, H.P., whereby the objections filed by the appellant, have been dismissed. Since, the appellant-company has already been amalgamated with M/s Sturdy Industries Limited and there is no one to pursue the present appeal, therefore, the same is dismissed for want of prosecution.
