All the petitioners since retired. Only two of the petitioners namely Azad Singh and Ram Singh are living, others have since expired. In the present case, petitioners’ recovery has been stayed by Hon’ble High Court vide orders dated 28.01.2005 and 20.05.2005, in view of the decision rendered by the Division Bench in Civil Writ Petition No.15821 of 2003 and 13772 of 1999. In view of these facts, it has been stated by the learned State Counsel, appropriate order be passed. We have perused the judgments rendered by Hon’ble Division Bench of this Court in Civil Writ Petition No.15821 of 2003 and 13772 of 1999. The facts of the present petition were also similar. Hence, taken into the consideration, decision in those matters, recovery from the present petitioners also stayed by Hon’ble High Court. Now, all the petitioners have already retired and they have already taken benefit of previous orders granting step up increments. It has also been stated that similar placed employees were also granted the relief of the kind sought by the present petitioners. All the petitioners except two petitioners have also expired. In view of the same the stay already granted by Hon’ble High Court in this case vide orders dated 28.01.2005 and 30.05.2005 is hereby made absolute.
