ANUPAMA CHAKRAVARTHY ORAL ORDER 9 15-06-2026 1.No representation on behalf of the appellant. 2.As the matter pertains to the year 2005, this Court have called for a report from Superintendent of Police, Kishanganj regarding the live status of the appellant. 3.In compliance with the order of this Court, this Court has been received a report from the Superintendent of Police, Kishanganj vide Letter No. 136 dated 13.04.2026. The report discloses that the whereabouts of the sole appellant, namely, Babul, s/o Alimuddin, have not been known for the last fifteen years. 4. As per the Criminal Law, any person unheard is deemed to be dead as the appellant Patna High Court CR. APP (SJ) No.380 of 2005(9) dt.15-06-2026 2/2 whereabouts were not known or unheard.
