Learned counsel for respondent-U.T Administration has submitted that the prayer in the petition is for challenge to the Notifications (Annexures P-2, P-3) dated 31.01.1992 and 29.01.1993, respectively and Award dated 05.03.2003 (Annexure P-4) passed under Section 4 of the Land Acquisition Act as well as under Section 6 of the Land Acquisition Act, 1894. 3. She submits that on 28.11.2008, the matter was adjourned sine die because with regard to the same acquisition and pertaining to the same Pocket, the matter was pending before Hon’ble the Supreme Court in SLP Nos.13143-13144 of 2008. She submits that now by way of judgment passed by Hon’ble the Supreme Court in Civil Appeal No.4265-4266 of 2008, the matter has been decided by Hon’ble the Supreme Court with regard to the same Notifications and same pocket i.e Scheme No.3, Pocket No.8 and the RAJEEV PUROHIT 2026.09.02 17:42 I am approving this document CWP-10960-2004 2 SLP has been dismissed and the acquisition has been upheld. She further submits that in this way, the present case is squarely covered in favour of the respondent-Chandigarh Administration in view of the aforesaid judgment passed by Hon’ble the Supreme Court. 4. In view of the above, the present petition is dismissed. 5. However, the liberty is granted to the petitioner that in case any cause of action survives, then any appropriate application may be filed for revival of the present petition.
