Daily Lok Adalat Bench No.4 504 RSA-103-2004 (O&M) Ashok Kumar Vs. State of Haryana and another Present:- None for the appellant. Mr.Jasvir Singh, AAG Haryana. *** Notice issued to the appellant and his counsel Mr.S.P.Singh, Advocate has been received back with the report that both have since died. Plaintiff-appellant had filed suit challenging adverse remarks recorded in the ACR for the year 1993-94 and dismissal of his representation against said adverse remarks. Trial Court decreed the suit but first appellate Court allowed first appeal filed by the defendants and consequently dismissed the suit. Hence the second appeal by the plaintiff. In view of death of the plaintiff-appellant, this appeal relating to adverse remarks in ACR has become infructuous and is disposed of accordingly. Copy of this order be supplied/sent to the counsel/parties. Pending applications, if any, shall stand disposed of.
