The record reveals that the writ petition was dismissed for non- prosecution vide order dated 02.01.2024. However, considering the averments and contentions made in CMAPL No.255 of 2024, this Court vide order dated 25.09.2024 restored this writ petition to file. 3. Perusal of record reveals that on 20.06.2007, this Court directed as follows: “Issue notice to Opp. Party Nos.3, 4 and 5 through a Special Messenger, as desired by the learned counsel for the petitioner, for which cost shall be deposited within three days. List this case on 29th of August, 2007 for final disposal at admission stage on which date relevant record as well as Rules and the terms and conditions applicable to the agents of the bank shall be produced by the said Opp. Parties.” 4. Office note dated 02.01.2024 reveals that notice directed to be served through Special Messenger could not be issued as the petitioner/his counsel has not deposited the cost. It is also further revealed that instead of filing three sets of requisites for issue of notice to opposite party Nos.3 to 5, the counsel for the petitioner filed only two sets of requisites for issuance of notice to opposite party Nos.3 and 4. 5. Faced with such situation, this Court has no option but to dismiss the writ petition for non-compliance of the order of this Court as directed vide order dated 20.06.2007. 6. Since no one represented for the petitioner to prosecute the matter and the matter pending since, 2003 and the fact that the petitioner has not complied with the order of this Court as directed vide order dated 20.06.2007, the writ petition stands dismissed on such scores.
