Brief facts of the prosecution case are that on 25.08.2003, Head Constable Sarwan Singh, along with Constable Neel Kamal and other police officials, was going on pavement of canal towards Village Ghasitpur. When the police party reached a short distance from Talwandi PANKAJ KAKKAR 2026.07.16 19:28 I attest to the accuracy and authenticity of this order/judgment CRR-2433-2008 2 Adda, they noticed the accused, Harjinder Singh, was coming on a bicycle from the opposite direction. On noticing the police party, the accused allegedly became perplexed and attempted to turn back, thereby arousing suspicion. He was immediately apprehended by the police officials. Before conducting the search, the Investigating Officer made efforts to associate independent witnesses, however, despite such efforts, no person agreed to join the proceedings. Thereafter, Head Constable Sarwan Singh conducted the search of the accused and recovered a gunny bag tied to the bicycle containing two plastic cans of illicit liquor without any valid permission or license. A sample of 180 ml of illicit liquor was drawn from each of the cans. Upon measurement, the remaining liquor in each can was found to be equivalent to 49 bottles of 750 ml each and one bottle containing 570 ml. Thereafter, the sample bottles as well as the cans containing the remaining illicit liquor were sealed at the spot by the Investigating Officer. The sealed samples, the cans, and the bicycle were taken into possession. Thereafter, HC Sarwan Singh recorded the facts in the ruqa and sent the same to the Police Station for registration of the formal FIR.
