- The prayer in the present petition under Article 226 of the Constitution of India is for issuance of directions to release the petitioner on 04 weeks emergency parole in FIR No.309 dated 17.07.2002 under Sections 302 IPC (Section 103 BNS) and Section 25 of the Arms Act registered at Police Station Jhajjar, District Jhajjar to enable him to attend the Terhevi ceremony/Rasam Pagri of his father;Satbir Singh which is fixed for 06.05.2026 and mahina/Chhemahi/Barsodi ceremony which is fixed for 25.05.2026 as the father of the petitioner expired on 26.04.2026. 2. The learned counsel for the petitioner contends that the petitioner has been in custody for more than 20 years on his being convicted in FIR No.309 dated 17.07.2002 under Sections 302 IPC (Section 103 BNS) and Section 25 of the Arms Act registered at Police Station Jhajjar, District Jhajjar. ceremonies are to be conducted by the petition who is the son on 06.05.2026 and 25.05.2026 and therefore, he be granted 04 weeks emergency parole. 3. The learned counsel for the State has not disputed the factual position that the father of the petitioner passed away on 26.04.2026 and that some religious ceremonies are to take place on 06.05.2026 and 25.05.2026. She, however, states that the stringent conditions be imposed upon the petitioner. 4. I have heard the learned counsel for the parties. 5. In view of the contentions raised by both sides, the present petition is disposed of with the directions to the appropriate authority to grant emergency parole to the petitioner beginning from 05.05.2026 till
26.05.2026. The petitioner shall surrender on 26.05.2026 at 10.00 a.m. before the Jail Authorities. 6. The pending application(s), if any, shall stand disposed of accordingly.
