DEEPAK GUPTA , J.(Oral) Learned counsel for the appellant has placed on record the copy of the statement dated 25.01.2003, which was made by learned counsel for the decree holder – Confed (respondent No.1 herein), whereby he had received a cheque of `99,000/- before the Execu/ng Court and had specifically stated that the execu/on stood sa/sfied. Therea3er, the appellant herein, i.e. J.D. had made a statement that in case, his RSA pending before this Court is accepted, then he will be en/tled to receive back the money paid by him. 2. Pursuant to the aforesaid statement of both the sides, the execu/on was disposed of as sa/sfied by the Execu/ng Court on 25.01.2003. 3. Today, learned counsel for the appellant submits that in view of the fact that the amount has already been deposited by the appellant before the Execu/ng Court and the execu/on stands sa/sfied, the appellant does not want to pursue the present appeal and withdraws the same. 4. In view of the aforesaid statement, present appeal is hereby dismissed as withdrawn.
