In the instructions dated 22.01.2026 of Mr. A.K. Parida, PC, CBI, ACB, Bhubaneswar in CRA No.39 of 2001, it is stated that on verification Mr. Babuli Pattanaik, younger brother of the Appellant - Sailendra Kumar Patnaik (CRA No.39 of 2001) informed that the Appellant - Mr. Sailendra Kumar Patnaik has expired since five to six years before and his family now lives in Delhi. But he could not obtain the death certificate of Sailendra Kumar Patnaik. 2. In view of the death of the sole Appellant - Sailendra Kumar Patnaik, the CRA No.39 of 2001 is abates and is disposed of as such. 3. None appears for the Appellant in CRA No. 40 of 2001 when the matter is called. 4. As per the report of the CBI, the appellant - Dillip Kumar Das is alive, hence in the interest of justice one more chance is given for appearance of his counsel. 5. List this case on 16.02.2026. 6. If no counsel appears on behalf of the appellant, this Court will appoint an experienced counsel to argue the appeal on behalf of the Appellant.
