1. The present writ petition has been filed under Article 226 of the Constitution of India for quashing of the impugned ex parte award dated 27.7.1995 (Annexure P-7) and the order dated 08.9.1999 (Annexure P-14) whereby the application for setting aside the ex parte award dated 27.7.1995, has been dismissed.
2. In the present case, notice of motion was issued on 18.4.2001 and the operation of the impugned award was stayed.
3. The matter is pending adjudication since 2001.
4. There is no representation on behalf of respondent No. 2. On 01.8.2002, Mr. K.S.Kapur, Advocate appeared on behalf of respondent No. 2. However, since then, none has put in appearance on behalf of respondent No. 2, despite the matter having been listed on several occasions.

Learned counsel for the petitioner has placed on record copy of the settlement under Section 18(1) of the Industrial Disputes Act, 1947 GURPREET SINGH 2026.08.07 16:39 I attest to the accuracy and integrity of this document Chandigarh

arrived at between the petitioner and Santokh Singh-respondent No. 2/workman, which is taken on record. As per the terms of the said settlement, the petitioner-department has paid a sum of Rs. 40,000/- to respondent No. 2 towards full and final settlement of all his claims. The settlement further records that respondent No. 2 has relinquished his right to reinstatement and/or re-employment and has undertaken not to raise any industrial dispute or assert any claim before any authority or Court of law in respect of the subject matter of the present proceedings.
6. Accordingly, in terms of the above settlement, the present writ petition is disposed of. The parties shall remain bound by the terms and conditions mentioned therein.
7. However, liberty is granted to respondent No. 2 to move an appropriate application for seeking revival of the present writ petition, within a period of four weeks from today, in case any substantive issue still exists along with a cause of action to respondent No. 2.
8. Pending miscellaneous application(s), if any, also stands
disposed of.
