ORDER The petitioner, with a grievance that the respondent Police – CBCID has not conducted the investigation in a proper manner and has suppressed certain material facts and also not arrayed the main accused in this case, has filed this writ petition seeking transfer of investigation from CBCID to CBI.
2. When this petition was taken up for hearing on 17.03.2026, the learned Additional Public Prosecutor, based on the instructions provided to him, submitted that the final report has already been filed before the concerned Judicial Magistrate on 21.03.2025 through e-filing in LTN 20250000678C202500001, however, it has not been taken on file. The investigating officer has given a letter to the learned Judicial Magistrate No.IV, Madurai, on 22.01.2026, requesting to take steps to number the case. Thereafter, the learned Judicial Magistrate has taken the final report on file in Crl.M.P.No.105 of 2026 dated 20.02.2026 and issued notice to the complainant for raising objections, if any, for the final report filed by the investigating officer. 3/6 https://www.mhc.tn.gov.in/judis

3. The learned counsel appearing for the petitioner sought time to ascertain the same and to advise the petitioner to appear before the concerned Judicial Magistrate and raise her objections to the final report.
4. Considering the request made by the petitioner, the matter stand adjourned.
5. Today, when this writ petition is taken up for hearing today, the
learned counsel for the petitioner submits that the petitioner appeared before the learned Judicial Magistrate and also filed a protest petition. Therefore, he is not pressing this petition.
