1. Perused the FIR as at Annexure-1. In spite of the Court’s order dated 15th April, 2026, the petitioner did not appear for mediation. The mediation report has been received stating therein that it has been unsuccessful due to absence of the petitioner. As per the F.I.R. i.e. Annexure-1, the Court finds that there has been a transaction and receipt of Rs.5 lac by the petitioner through UPI and in order to settle the matter with the petitioner, he should have appeared before the High Court Mediation Centre, Cuttack pursuant to the Court’s order dated 15th April, 2026, but the petitioner did not appear to participate in the mediation. Considering the allegation in the FIR even though there is delay in lodging the FIR with the informant alleged cheating against him, the Court is not inclined to entertain his bail plea recording the submission of Mr. Sahoo,
learned counsel for the informant, who opposed any such release for the reasons stated.
2. Accordingly, it is ordered.
3. The ABLAPL is dismissed, however, granting the liberty to the petitioner to surrender in the Court of learned S.D.J.M., Berhampur in connection with Badabazar P.S. Case No.588 of 2025 seeking regular bail for its consideration on merit.
4. Issue urgent copy of the order as per rules.
