None for the respondent. **** HARKESH MANUJA, J. (ORAL) Plaintiff-Punjab Agro Industries Corporation Ltd. has filed the present Regular Second Appeal. [2] By way of present appeal, challenge has been laid to the judgments and decrees dated 04.06.1997 & 29.02.2000 passed by both the Courts below, whereby the dismissal of suit for recovery of Rs. 1 lakh filed at the instance of plaintiff was affirmed. [3] On the last two dates of hearing i.e. 21.04.2026 & 05.05.2026, the following orders were passed:- “ ORDER DATED 21.04.2026 On the last date of hearing as none appeared for the respondent, Registry was directed to issue notice to the respondent. DINESH KUMAR 2026.07.15 18:54 I attest to the accuracy and integrity of this document RSA No. 3155 of 2000 (O&M) -2- As per report of Registry, sole respondent has died. Despite having been informed through E-mail, learned counsel for the respondent has not put in appearance. In the interest of justice, adjourned to 05.05.2026. Registry is directed to inform learned counsel for the respondent about the date fixed before this Court. In the meantime, records of the Trial Court, if not received, be requisitioned for the date fixed and scanned copy of the same be uploaded on DMS. ORDER DATED 05.05.2026 As per report of Registry, sole respondent has died. Learned counsel for the appellant seeks some time to implead L.R(s) of the deceased-respondent. On his request, adjourned to 15.07.2026. To be shown in urgent list. In the meantime, records of the Trial Court, if not received, be requisitioned for the date fixed and scanned copy of the same be uploaded on DMS.” [4] Today, learned counsel for the appellant informs that an effort was made by him through the appellant-Corporation for obtaining the requisite information about the legal representatives of respondent-defendant and the same was answered through e-mail dated 01.07.2026 by the Corporation, which reads as under:- “ In reference to your trailing mail dated 12.05.2026, you are hereby informed that vide email dated 03.06.2026, HR Division PAIC stated “that as per the available records, the service record of Sh. Satpal Singh was duly weeded out/dispose of in the year 2020 in accordance with the instructions of the Punjab Government and with the approval of the Competent Authority. Further, as per disposed off list, Sh. Satpal Singh had been dismissed from service, and no record pertaining to his legal heirs is available with the HR Division.” DINESH KUMAR 2026.07.15 18:54 I attest to the accuracy and integrity of this document RSA No. 3155 of 2000 (O&M) -3- In view of above, you are requested to appraise the Hon’ble Court accordingly.” [5] A perusal of the record shows that despite having availed two opportunities, the appellant-Corporation has failed to make sincere efforts for impleading the legal representatives of the respondent-defendant and apparently, it appears that the appellant-Corporation is not serious to pursue/prosecute the present appeal. As a result thereof, there is no option except to dismiss the appeal for non-prosecution. [6] Dismissed for non-prosecution. [7] However, the appellant would be at liberty to seek its revival by instituting an appropriate application in case occasion so arise(s) as per law. [8] Pending miscellaneous application(s), if any, shall also stand disposed off.
