Through the instant writ petition, instituted as far back as the year 2000, the petitioner seeks issuance of direction to the respondents to release all his retiral benefits, including regular pension, commutation of pension, death-cum-retirement gratuity, leave encashment, travel concession, unpaid salary, etc., along with interest on account of delayed disbursement. 2. On the previous date of hearing, i.e. 29.01.2026, learned State counsel had informed this Court that the entire pensionary benefits, including gratuity, had already been released to the petitioner and, therefore, nothing survived for adjudication in the writ petition. Accordingly, the matter was adjourned to today, thereby enabling learned counsel for the petitioner to have appropriate instructions as to whether the said benefits had, in fact, been received by the petitioner. 3. Today, learned counsel for the petitioner submits that DEVINDER YADAV 2026.02.10 09:42 I attest to the accuracy and authenticity of this order/judgment CWP-4470-2000 (O&M) 2 although the petitioner has received the entire pensionary benefits, his claim for interest on account of delayed payment, in terms of the rules governing his service conditions, as well as his claim relating to the grant of annual increment and one special pay, has not been considered or decided by the competent authority. 4. In view of the above, insofar as the instant writ petition is concerned, no further direction or adjudication is required, and the same is accordingly closed. However, liberty is granted to the petitioner to submit a detailed representation to the competent authority raising his claims with regard to interest on delayed payment, annual increment, and special pay. In the event such a representation is filed within a period of 30 days from today, the competent authority shall consider and decide the same, in accordance with law, within a period of 60 days thereafter, after affording due opportunity of hearing to the petitioner. 5. Disposed of accordingly. 6. Pending application(s), if any, also stand disposed of accordingly.
