JUSTICE R.K. PATTANAIK Order No. ORDER 16.04.2026 01. 1. Heard learned counsel for the petitioner and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Phulbani Town P.S. Case No.0354 of 2025 corresponding to C.T. Case No.1092 of 2025 pending in the court of learned S.D.J.M., Phulbani on the grounds stated. 3. Perused the FIR as at Annexure-1. The report has been lodged by a Courier Service, namely, Blue Dart Express Limited alleging therein about misappropriation of an amount to the tune of Rs.4.75,636/- by the petitioner and others in employment at the relevant point of time. It is informed to the Court that the investigation is underway. The allegation is that the amount was collected by the petitioner and co-accused persons and it was misappropriated without being deposited. The misappropriation is alleged for the period between July and August, 2025 with the claim that shipments were delivered to p. 2 the customers against COD money collection but it was not deposited with the Blue Dart. Considering the nature of allegation in the FIR and the role played by the petitioner as one of the employees of the informant and the alleged misappropriation is for a sum of Rs.4,75,636/- only, this Court recording the plea that there has been no other criminal case against him and objection of the State, directs that he should surrender before the learned court below for being released, as it is not inclined to entertain his plea for pre-arrest bail. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned S.D.J.M., Phulbani in connection with Phulbani Town P.S. Case No.0354 of 2025 corresponding to C.T. Case No.1092 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.50,000/-(rupees fifty thousand) with one solvent surety for the like amount with a further deposit of cash of Rs.50,000/- to be kept in an interest bearing account with any Nationalized Bank renewable from time to time with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
