Learned counsel for both the pares submits that they are not in touch with their respecve clients. Perusal of the record would reveal that simplicitor suit for seeking declaraon was filed by plainff Gurdas Ram (respondent No.1 herein), that he was Managing Director of Kamyab Chit Fund and Finance Pvt. Ltd. As stated by learned counsel, at the me of filing the appeal, appellant was 78 years of age, which means by now he must be 100+ years, in case, he is alive.
