1. As per the report of the Registry, the notice issued to the sole appellant has been received back with the report that he has expired.
2. A perusal of the case file reveals that on the last date of hearing i.e. 25.02.2026, neither the appellant nor anyone on his behalf appeared before this Court. It is further evident that on the last four consecutive dates of hearing, specific directions were issued to learned counsel for the appellant to take appropriate steps for impleading the legal representatives of the deceased appellant. However, despite such directions, today none has put in appearance on behalf of the appellant and no such steps have been taken by learned counsel for the appellant.

4. It, therefore, appears that the legal representatives of the appellant are not interested in prosecuting the present appeal.
5. Accordingly, the present appeal is dismissed in default for want of prosecution.
6. However, liberty is granted to the legal representatives of the appellant to seek revival of the appeal in accordance with law, in case any worthwhile cause survives for consideration.
7. Pending application(s), if any, shall also stand disposed of.
