As per the said report, the sole appellant-Anam Charan Biswal has expired on 25th July, 2026. The son of the deceased appellant Anam Charan Biswal has also given the written statement that his father has expired on 25th July, 2026. It is also reported that the sole respondent- Manindra Narayan Jena has also expired since last ten years. The brother-in-law of Manindra Narayan Jena has also given the written statement that Manindra Narayan Jena has expired since last ten years. The said report and the written statements are taken on record. Subhasis 2. In view of the above, the present appeal stands abated in absence of any application under Section 394 of Cr.
