Application bearing CM-3830-C-2024 has been filed by the applicants- appellants under Order XXIII Rule 3 read with Section 151 CPC for disposal of the appeal [RSA-483-1997] in terms of compromise deed dated 12.02.1997 (Annexure A-1), which is duly signed by contesting respondent – Om Parkash.

Learned counsel submits that after the decision of the First Appellate Court, a compromise had been effected between the parties, which was reduced into writing on 12.02.1997. Counsel for the appellants was not apprised to the same and he had filed the appeal on 10.02.1997. It is only later on that learned counsel for the appellant was informed regarding the said compromise. Respondent No.1, who is the only contesting respondent, has been proceeded ex parte on 27.05.1997.

Having regard to the contents of the compromise dated 12.02.1997 (Annexure A-1), the present appeal is hereby disposed of in terms of the said compromise, which shall form part and parcel of this order.
