JUSTICE DEEPAK GUPTA Present:- Mr. Amit Kumar Saini, Advocate for the appellants. DEEPAK GUPTA , J.(Oral) On the previous date of hearing, following order was passed:- “Respondent Nos.1, 2 and 4 were no$ced to have been duly served, as per order dated 28.02.2024. Till date, nobody has appeared on behalf of any of the aforesaid respondents. As such, all of them are proceed ex parte. Respondent No.3 was reported to have died; whereas address of respondent No.5 was stated to be wrong. The appellants have not complied with the order dated 28.02.2024 as neither any applica$on is moved to implead the LRs of deceased-respondent No.3 nor the correct address of respondent No.5 has been filed $ll date. Rather a wri0en request for adjournment is received on behalf of learned counsel for the appellants, due to some personal difficulty. Adjourned to 19.01.2026, making it clear that in case, the order dated 28.02.2024 is not complied with within next 15 days posi$vely, then the present appeal shall be liable to be dismissed for want of compliance. Registry is directed not to entertain any adjournment slip on behalf of any of the par$es.” Learned counsel for the appellants informs that the appellants are no longer in contact with them. It appears that the appellants are no longer interested in pursuing this appeal. Dismissed in default for want of prosecu$on.
