The present petition has been filed by the petitioner under Article 226 of Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking following reliefs: “A. Writ, Order or Direction in the nature of MANDAMUS , or any other writ, order or direction in favour of the Petitioner thereby directing the police to provide protection to the petitioner and ensure her safeguard of live and limb so that she can fight for justice. Any other order which the Hon’ble Court may deem fit and proper in the facts and circumstances of the present case be also passed.” This is a digitally signed order. Learned counsel for the petitioner submits that the petitioner is the victim in a rape case and is being continuously threatened by the friends and family members of Respondent No. 2 with a view to pressurise her to withdraw the case and not depose before the learned Trial Court. He further submits that Respondent No. 2 is involved in several criminal cases and, being a hardened criminal, poses a constant threat to the life and liberty of the petitioner. 6. It is further submitted that despite complaints made by the petitioner to the police authorities regarding the threats extended to her, no effective action has been taken by the police officials. 7. Having regard to the facts and circumstances of the case, the concerned SHO, Police Station DBG Road, is directed to look into the complaints made by the petitioner. The mobile phone numbers of the Beat Officer as well as the concerned SHO shall also be provided to the petitioner so that she may contact them in case of any emergency or distress. 8. It is further directed that, till such time as the petitioner moves an appropriate application before the Witness Protection Committee, Central District, Tis Hazari Courts, and the said application is decided, the concerned SHO shall depute a police official to visit the place where the petitioner is residing on a daily basis and enquire about her well-being so as to ensure that there is no threat to the life and liberty of the petitioner. 9. The telephone number(s) from which the petitioner has allegedly received threatening calls shall be provided to the concerned SHO. Upon receipt thereof, the SHO shall conduct an appropriate inquiry and place the outcome of such inquiry before the Witness Protection Committee for its consideration.
